As a former prosecutor of financial and business fraud with the Colorado Attorney General for nearly 10 years, Erik Neusch was lead counsel on the largest and most high-profile investigations and enforcement actions in the office, which resulted in the recovery of the most restitution, fines, and attorney fees in the consumer protection section’s history for actions by the Attorney General. This experience provides unique insight, background, and skill in defending governmental investigations and enforcement actions—and protecting your business. When your business is the subject of a governmental inquiry or action, you need a highly experienced attorney who was on the other side for years.

The investigations led by Erik at the Attorney General imposed severe punishment on businesses and individuals, including the loss of their business, and consequently he knows first-hand the importance of having a defense attorney who has the relevant experience and skill in navigating and defending governmental investigations and enforcement matters.

Erik’s experience and background includes civil investigations and subpoenas by the Colorado Attorney General under the Colorado Consumer Protection Act (CCPA); multi-state attorneys general inquiries; parallel criminal and civil proceedings; regulatory proceedings and hearings; and investigations by the United States attorneys, local district attorneys, and state regulatory agencies, including the Colorado Department of Regulatory Agencies. Erik has extensive experience working side-by-side with investigators and attorneys from various law enforcement and governmental agencies in Colorado and the United States. He has not only directed the largest governmental investigations in the office, he took some of these cases through trial and appeal, providing rare insight of the entire process from beginning to end and knowing the entire process that can benefit clients.

Erik’s background at the Attorney General also provides unique insight into governmental regulation and compliance issues for financial services, real estate, title insurance, insurance, and other businesses subject to governmental oversight and regulation. He can assist businesses with compliance issues on the front end before a formal investigation or proceeding commences. With state regulators, including state attorneys general, exercising an increasingly active regulatory role, Erik’s knowledge and experience are well-suited for this new landscape.
